The petitioner seeks bail in a case registered under Sections 147, 148, 149, 353, 307, 323 of the Indian Penal Code and Sections- 4 & 5 of Explosive Substances Act. The prosecution case in short is that on secret while the informant along with police personnel reached near the Chambers of the Principal of Patna College, the students were found putting pressure upon the principle for allotment of hostel and in consequence thereof, the mob of 50-60 students became aggressive and threw bomb upon the police force, present near the Chambers of Principal. Patna High Court CR. MISC. No.54228 of 2019(2) dt.28-08-2019 2/2 is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 02-08-2018. Charge sheet has already been submitted. It is submitted that general and omnibus allegation has been made against the petitioner. No specific overtact is attributed against the petitioner. None is said to have sustained injury in course of the occurrence. The other co-accused with similar allegation has been granted bail by this court vide order dated 05-10-20189 passed in Cr. Misc. No. 54547 of 2018.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Pirbahore P.S. Case No. 503 of 2017.
