JUSTICE MADHURESH PRASAD ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is an accused in a case registered for offence under section 414 of the Indian Penal Code. Allegation against the petitioner is that he along with other was indulged in selling stolen motorcycles.

Petitioner has been implicated in the case due to village politics by the husband of elected Sarpanch and earlier also he had lodged a case against him which has been disclosed in paragraph 3 of the bail application. Charge sheet has also been filed in this case, as such, there is no chance of tempering the witnesses. Petitioner is in custody since 6.5.2017. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Samastipur in Tajpur Police Station Case No. 163 of 2017 on the following conditions :- (a) One of the bailors will be a close relative of the
