Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 448, 307 and 379/34 of the Indian Penal Code, registered in connection with Jainagar P.S.case No. 361 of 2020.

As per allegation, when the informant went to demand school fee from the accused persons, they badly assaulted him and his mother.

The learned counsel for the petitioner has submitted that he is a person of clean antecedent. As a matter of fact, the son of the petitioner was a student in the school conducted by the informant. The petitioner withdrew his son from the school and it was the reason that he has been falsely implicated in this

Patna High Court CR. MISC. No.66378 of 2021(2) dt.25-07-2022 2/2 case. He has submitted further that the injuries are simple in nature.

Considering the above facts and circumstances as well as the clean antecedent of the petitioner, let him above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Madhubani in connection with Jainagar P.S.case No. 361 of 2020 (CRI Case No. 2060 of 2020), subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
