ANJANA MISHRA ORAL ORDER 19-08-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Lodipur P.S. Case No. 39 of 2016, for the offences registered under Sections 323, 341, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the present case is counter blast to the earlier case filed by the brother of the present petitioner in which, the brother of the petitioner was seriously injured and had lodged a case against informant of the present case which has been marked as Annexure-3 to the present application.

It is further, submitted that though an allegation has

Having considered the facts and circumstances of the case and the injury which is purported to have been inflicted by the petitioner side i.e the injury on Pushplatla Devi, was found to be simple in nature. In view of the aforementioned facts and circumstances and also because the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur, in connection with Lodipur P.S. Case No. 39 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
