JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Buxar Industrial P.S.Case No. 175 of 2016 registered under Sections 147, 148, 149, 307, 323, 324, 341 and 302 of the Indian penal Code.

Allegation in brief is that on account of land dispute, all the accused persons assaulted the deceased leading to his death. Submission is that there is no specific allegation against the petitioner and similarly situated another co-accused persons namely Sanjay Choubey have been admitted to bail by a coordinate Bench of this Court vide order dated 11.09.2017 passed in Cr. Misc. No. 42060 of 2017.

Learned counsel appearing on behalf of the informant submits that prior to grant of bail to Sanjay Choubey, bail

Patna High Court Cr.Misc. No.59033 of 2017 (3) dt.19-01-2018 2/2 application of another co-accused Vijay Kumar Choubey was rejected by this Court.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Ajay Choubey is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Buxar (Industrial) P.S. Case No. 175 of 2016, with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of absence on two consecutive dates without any cogent reason, his bail bond shall be liable to be cancelled.
