The petitioner is apprehending his arrest in connection with Sadar P.S. Case No. 353 of 2018 for the offence under Sections 294(A), 420 and 34 of the Indian Penal Code and Section 27(3) of the Lottery Regulation Act, 1998. Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent. Referring to the prosecution case he submits that the instant case was registered at the instance of A.S.I. Amarjeet Kumar of Sadar police station. He submits that the informant apprehended Dilip Choudhary and Rakesh Sah and on their disclosure petitioner has been named in the instant case as one of the person who involved in sale and purchase of lottery ticket.

No.71264 of 2018(2) dt.17-12-2018 2/2 Considering the fact that the petitioner has no criminal antecedent and the name of the petitioner surfaced on the confessional statement of co-accused, let the petitioner above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Court of learned Chief Judicial Magistrate, Purnea, in connection with Sadar P.S. Case No. 353 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C.
