Mr.Sri Manoj Kumar - 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, being the lady Supervisor under Block Child Development Project, Block - Lakari Nabiganj in the District of Siwan is apprehending her arrest in a case registered for the offences punishable under Sections 420, 468, 504 and 506/34 of the Indian Penal Code.

It is alleged that the petitioner in league with other officials engaged Anganwari Sevika of Ward No. 16 on the basis of forged educational certificate.

It is submitted by learned counsel for the petitioner that the petitioner was not the appointing authority, she only handed over the engagement letter, hence, she cannot be blamed that the selection of the Anganwari Sevika was made on the

Patna High Court Cr.Misc. No.73681 of 2018(2) dt.20-12-2018 2/2 basis of forged educational certificate. Moreover, the said Anganwari Sevika has already been terminated on 14.06.2018. Learned APP submits that the petitioner was also responsible for the appointment on the post of Anganwari Sevika.

Considering the thrust of accusation against the appointing authority and the petitioner being a lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 260 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
