ANJANA MISHRA ORAL ORDER 19-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as Learned counsel appearing on behalf of the informant. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code and Section (3)(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Diary in this case was called for earlier which has since been received.

Learned counsel for the petitioner submits that so far as the allegation against Section (3)(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 is

Patna High Court Cr.Misc. No.25611 of 2016 (3) dt.19-08-2016 P2/2 concerned, no case is made out as apparently no caste name has been used to insult.

In view of the fact that there is no specific allegation against this petitioner and only allegation is that one Vijay Kewat had taken away the husband of the informant for Panchayati and, there being no cogent material in the case diary against the present petitioner, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Nawada, in connection with Warsaliganj P.S. Case No. 18/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
