JUSTICE RAVI RANJAN ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 272, 273 of the Indian Penal Code and Section 47, 47 (A), 48, 53 and 55 of the Bihar Excise Act. It is contended that, as per allegation, a huge quantity of foreign as well as country made liquor were recovered from the Pick Up Van. Nothing has been recovered from the possession of the petitioner. The name of the petitioner has come on the basis of confessional statement of co-accused (driver of the said van). It is contended that similarly situated co-accused, namely, Balmiki Singh has already been granted bail by a co-ordinate Bench of this Court vide order dated 21.08.2017 passed in Cr. Misc. No.17104/2017. It is urged that the petitioner is in custody since 8.09.2017. It is claimed that his antecedent is clean.

No.51492 of 2017(2) dt.09-11-2017 2/2 Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 7th Additional Sessions Judge-cum-Special Judge, Excise Act, East Champaran, Motihari in connection with Pakaridayal P.S. Case No. 112 of 2015 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
