JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are said to have opened fire causing firearm injury to informant as well as his son but submission on behalf of the petitioners is that there is case and counter case between the parties and as a matter of fact, prosecution party was aggressor and petitioner no. 2 as well as his wife sustained injuries.

No doubt, the informant and his son sustained grievous injury said to be caused by firearm but considering the aforesaid facts, particularly, keeping in mind that petitioner no. 2 and his wife, too, sustained injury and lodged case against the prosecution party, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with

Patna High Court Cr.Misc. No.56693 of 2015 (2) dt.15-12-2015 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Nauhatta (Darhar O.P.) P.S. Case No. 109 of 2015.
