JUSTICE SUDHIR SINGH ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Sherghati (Dobhi) P.S. Case No. 282 of 2015 for the offence instituted under Section 394 of the Indian Penal Code. It is alleged that four unknown persons came on a white colour Bolero vehicle and snatched cash and valuable article and documents from the informant and fled away.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has figured on the confessional statement of co-accused. No looted articles are said
Patna High Court Cr.Misc. No.37130 of 2016 (4) dt.16-01-2017 to have been recovered from the possession of the petitioner. The other co-accused has been granted anticipatory bail vide Cr. Misc. No.37497 of 2016 by another co-ordinate Bench of this Court. On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Sherghati (Dobhi) P.S. Case No. 282 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Gaya subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
