Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The informant claims to be an eye-witness of the occurrence. According to FIR, three persons including the petitioner fired at the son of the informant causing his death. The occurrence took place for land dispute.
Submission is that the petitioner is in custody since 23.01.2017. The police has not sent up co-accused Hardwar Singh, the co-culprit, for trial and the post-mortem report would reveal that single would was found on the person of the deceased. There is no other eye-witness to attribute anything specific against

Considering the entire aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Karpi Police Station Case No. 155 of 2013, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
