1. Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant.

2. A prayer for bail has been made on behalf of petitioner in connection with Chautarwa P.S. Case no.166 of 2025 registered under Section 96 and 3(5) of the B.N.S, 2023.

3. The allegations in the F.I.R is that petitioner along with others allured the informant's daughter and took her away from her house.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. It is the case of love affair between the petitioner and the daughter of the informant and the same would also be demonstrated by the fact that victim upon her recovery stated in her statement recorded under Section 183 B.N.S.S that she went with the petitioner out of her own will. It is further submitted that there has been compromise between the parties which fact also stands

Patna High Court CR. MISC. No.61411 of 2025(4) dt.15-11-2025 2/2 supported by learned counsel for the informant. The petitioner is in custody since 08.06.2025 and has no criminal antecedent. He undertakes to cooperate in the case/trial.

5. The application for bail is opposed by learned A.P.P. for the State.

6. Taking into consideration the above mentioned facts of the case and also considering the fact that there was mutual love relationship between the petitioner and informant's daughter and the victim in her statement does not disclose any physical abuse etc. at the hands of the petitioner coupled with the fact that parties have settled the issues amongst themselves and the petitioner is in custody since 08.06.2025, having no criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Chautarwa P.S. Case no.166 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/Successor Court.
