JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420,467,468,471,472,475,476 and 504/34 of the Indian Penal Code.

The prosecution case is that the accused persons including the petitioner used to cheat unemployed youths on the pretext of providing them employment. The informant contacted on mobile number and went to the accused persons. One of the accused persons demanded rupees five thousand as registration charge for appearing at the examination. Subsequently, the informant was shown failed in the examination and thereafter rupees five thousand more were taken under different heads but

Patna High Court Cr.Misc. No.37566 of 2016 (2) dt.09-09-2016 2/2 no employment was provided. Similar collection was made from Suraj Kumar but no job was provided. Rupees seven thousand is claimed to have been deposited in the account of co accused Sarvesh Kumar.

It is submitted by the learned counsel for the petitioner that only accusation against the petitioner is that he was found sitting in the office. There is nothing on record to suggest that the petitioner was, in any way, connected with the alleged offence. There is no proof with regard to any payment made to the petitioner.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Patna City in connection with Chowk P.S. Case No.27 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
