Petitioners are apprehending their arrest in connection with Nawkothi PS Case No. 99/2017 for the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel representing the petitioner submits that the petitioners have no criminal antecedent. He further submits that similarly circumstanced co-accused Rajesh Kumar and Dheeraj Kumar have been granted anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. Nos. 33251 of 2018 and 33865 of 2018 vide orders dated 11.07.2018 and 12.07.2018, respectively.

Considering the aforesaid, this application is allowed.

Sessions Judge II-cum-Special Judge, Excise, Begusarai in connection with Nawkothi PS Case No. 99 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure (Anil Kumar Upadhyay, J) mrl./- U T
