JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-04-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 341, 323, 354 (B), 379 and 34 of the I.P.C Allegedly, the petitioner and three unknown being armed dragged Mamta Kumari in bamboo clamp and snatched her all ornaments valued Rs. 50,000/-, the other girls who were with Mamta Kumari raised alarm but Mamta Kumari was injured, she was molestated.

Submission is of false implication and that the petitioner has been made victim of the circumstances, there is no injury report attached with the case diary which goes to reveal that the informant has not received any injury and the allegation of snatching of ornaments is super addition, due to the previous

Patna High Court Cr.Misc. No.56716 of 2015 (4) dt.20-04-2016 2/2 enmity the petitioner has been implicated in this case. The learned A.P.P. opposes prayer for bail of the petitioner by submitting that the pass-book and the voter I.D. Card standing in the name of Sulekha Devi, the wife of the petitioner, were recovered from the place of occurrence which was produced before the Officer Incharge.

In the facts and circumstances as stated above, considering that charge sheet has already been submitted and there is no chance of tampering with the prosecution evidence and as such considering detention of the petitioner, now he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pradeep Kumar Chaudhary, J.M. 1st Class, Udakishunganj, Madhepura in Puraini P.S. Case No. 54 of 2015/ G.R. No. 619 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
