The petitioner seeks pre-arrest bail in connection with Azimabad P.S. Case No. 37 of 2019 for the offences alleged under Sections 341, 323, 324, 308 and 504 of the Indian Penal Code.
The accusation is that on 06.06.2019, the petitioner had gone at the grocery shop of the informant, Sanoj Paswan, and requested to give the articles on borrow, but, the informant refused. Due to that reason, on next day, in the morning, while the informant was present at his shop, the informant with an edged weapon caused injury at his head and fled away, due to which the informant received injury. It is, further, alleged that the occurrence took place at the instigation of parents of the petitioner.
Patna High Court CR. MISC. No.52502 of 2019(2) dt.22-08-2019 2/2 The submission of the learned counsel for the petitioner is that the injury caused at the head of the informant is simple in nature caused by hard and blunt substance. Petitioner has no criminal antecedent.
Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.
Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Azimabad P.S. Case No. 37 of 2019 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
