JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Some mobile sets are said to have been recovered from conscious possession of the petitioner but submission on behalf of the petitioner is that the seized mobiles do not tally with the description of stolen mobiles. Moreover, even if, prosecution story assumed to be true, then also, petitioner purchased the said mobile phones as bona fide purchaser. The petitioner does not have any criminal antecedent.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Basantpur P.S. Case No. 180 of 2015 to the satisfaction of Chief Judicial Magistrate, Siwan.
