The petitioner apprehends his arrest in Rajeev Nagar P.S. case No. 23 of 2016 under Section 394 of the Indian Penal Code.
The petitioner is not named in the FIR. The informant alleged that three persons came on a motor cycle and robbed him of his different belongings. Registration No. of motor cycle on which the criminals came is 2954.
It is submitted that petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner but it appears that Rahul Kumar was apprehended and from his possession looted articles were recovered. Rahul Kumar is owner of the motor cycle bearing registration No. 2954. Other accused
Patna High Court Cr.Misc. No.25907 of 2016 (3) dt.20-08-2016 2/2 persons have also disclosed the name of the petitioner as one of the accomplice.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
