ANJANA MISHRA ORAL ORDER 05-02-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are in custody since 23.09.2015 in connection with Wazirganj P.S. Case No. 111 of 2006, registered for offences punishable under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is a general and omnibus allegations against the petitioners and that out of many accused persons named in the F.I.R., two persons have already been acquitted in connection with the present case. It is further submitted that, admittedly, the occurrence took place on account of an election dispute between the rival parties resulting
Patna High Court Cr.Misc. No.364 of 2016 (3) dt.05-02-2016 2/2 into lodging of the present F.I.R.
Considering the aforementioned facts and circumstances, period of custody and also that these petitioners have no criminal antecedent, let the petitioners, namely, 1. Vishundeo Prasad 2. Suresh Mahto 3. Deonandan Prasad, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Jigar Shah, learned Judicial Magistrate Ist Class, Gaya, District - Gaya, in connection with Wazirganj P.S.
