The petitioner is seeking regular bail in connection with S.T.No.585 of 2016 in Cheria Bariarpur P.S.Case no.84 of 2016 registered for offences punishable under Sections 364(A)/34 of the Indian Penal Code.
Earlier the prayer for bail of the petitioner was rejected by this Court with an observation to the learned trial court to conclude the trial within a period of six months. Submission of the learned counsel for the petitioner is that the period has already expired and the trial has not been concluded.
It appears from perusal of the record that a report was called for, which is kept at flag 'G' and it appears that the case is fixed
Patna High Court Cr.Misc. No.52003 of 2017 (3) dt.06-12-2017 2/2 on 27.11.2017 for defence evidence and as such now the defence has to expedite the evidence.
Considering the same, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and conclude it within two months of the date when the evidence of defence is closed.
With the aforesaid observation, this application is disposed of.
