The petitioner apprehends his arrest in Complaint case No. 2128 of 2013 under Section 420, 406 of the Indian Penal Code.

The complainant alleged that when he visited his house the petitioner approached him and took Rs. 2,50,000/- for preparing cassette of devotional songs but the petitioner did not return the money nor paid any amount from the income. It is submitted that petitioner has also filed a complaint case against the complainant. The complainant was on visiting terms with the petitioner and if the petitioner has taken

Patna High Court Cr.Misc. No.25955 of 2016 (3) dt.20-08-2016 2/2 any amount the complainant should have filed suit for recovery of the amount. The petitioner is denied to have taken any money from the complainant.

It appears that this is simply a case of lending of money and on account of that the dispute arose between the parties.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri V. K. Chaubey, learned Additional Chief Judicial Magistrate-X, Muzaffarpur in Complaint Case No. 2128 of 2013, Tr. No. 446 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
