JUSTICE AMARESH KUMAR LAL ORAL ORDER 30-01-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is in custody since 29. 01. 2014 in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

During investigation the petitioner has made confession and looted article has been recovered from the possession of the petitioner as well as co-accused, namely, Raj Kumar Singh. It is submitted that co-accused Raj Kumar Singh has been granted bail by this Court vide order dated 26. 09. 2014 in Cr. Misc. No. 37463 of 2014 and the case of the petitioner on similar footing.

Learned counsel for the State submits that petitioner has also criminal antecedent.

Patna High Court Cr.Misc. No.45491 of 2014 (2) dt.30-01-2015 Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Mirganj P.S. Case No. 137 of 2012 after framing of the charge with the following conditions :

1.

One of the bailors will be the close relative of the petitioner.

2.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
