The petitioner seeks regular bail in connection with Jehanabad PS case no. 353 of 2017 instituted for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 1862 bottles of liquor from the abandoned school building. The learned counsel for the petitioner submits that the petitioner is not named in the FIR and on the basis of the confessional statement of co-accused, he has been roped in the present case although he has got nothing to do with the alleged occurrence. It is further submitted that the petitioner is in custody
Patna High Court Cr.Misc. No.60250 of 2017 (2) dt.21-12-2017 2/2 since 08.11.2017. As far as the criminal antecedent of the petitioner is concerned, two other cases on the same and similar accusation are pending against him however, he has been granted bail in one of the case and the other bail petition is pending for consideration.
Considering the nature of accusation and the period of custody undergone, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J. II, Jehanabad in connection with Jehanabad PS case no. 353 of 2017.
