JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are not named in the first information report, which has been lodged on the basis of fardbyan of the injured against one FIR named accused, Charitra Sah @ Ranjeet Sah and two unknown persons but it appears that in course of investigation, when the further statement of informant was recorded, he named the petitioners without levelling any specific overt act against them.

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that petitioners do not have any criminal antecedent, let petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the

Patna High Court Cr.Misc. No.57167 of 2015 (2) dt.18-12-2015 2/2 like amount each in connection with Matiariya P.S. Case No. 48 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran.
