The petitioner is in custody since 22.04.2019 in connection with Jhajha Rail P.S. Case No.97/2018 registered for the offence punishable under Sections 395, 412 of the IPC. Learned counsel for the petitioner submits that the name of the petitioner has surfaced in the confessional statement made before the police by co-accused which has got no evidentiary value. It is further submitted that there is no recovery from the petitioner nor he has been placed on TI parade. Further save and except one other case in which petitioner has been implicated, the petitioner is not having any other criminal antecedent.

Considering the aforesaid facts and circumstances of the case and that the name of the petitioner surfaced in the

Patna High Court CR. MISC. No.55665 of 2019(2) dt.18-09-2019 2/2 confessional statement made by a co-accused before the police, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of ACJM, Railway Kiul, Lakhisarai in connection with Jhajha Rail P.S.
