Petitioners seek regular bail in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code.

As per the prosecution case, petitioner No.1 assaulted the informant with spade on his and petitioner No.2 assaulted the wife of informant with iron rod on her head as a result of which they sustained injuries.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is submitted that occurrence took place due to land

Patna High Court CR. MISC. No.67539 of 2021(3) dt.25-04-2022 2/2 dispute between the parties with regard to a pathway and there was no intention to kill. Petitioners claim clean antecedent and are in custody since 14.07.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Purnea in connection with Rupauli PS case No.112/2021.
