The petitioner in the present case is seeking regular bail in connection with Mohania P.S. Case No.288 of 2019 registered for the offence punishable under Section 401 of the Indian Penal Code, Sections 25(1-b)A, 26 of the Arms Act and Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to ulterior motive. Learned counsel submits that nothing has been recovered from the conscious possession of the petitioner. He is in custody since 23.06.2019.

Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.52173 of 2019(3) dt.20-11-2019 2/2 wherein this petitioner has been arrested in course of raid conducted by police and huge arms and ammunitions as also illicit liquor have been recovered from the house from where this petitioner has been arrested, this Court is not inclined to grant regular bail to the petitioner at this stage. This application is dismissed.
