JUSTICE MUNGESHWAR SAHOO ORAL ORDER 16-12-2015 Heard the learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners, namely, Bhuti Sah @ Santosh Kumar Sah and Sujeet Sah are in custody in Darihat P.S. Case No.50 of 2015 under Sections 341, 323, 325, 307/34 of the Indian Penal Code.

The learned counsel for the petitioners submitted that there was case and counter case between the parties and there is land dispute. The petitioners have also filed complaint case under Section 307 I.P.C. In the present case, after investigation, chargesheet has been submitted under Section 325 I.P.C. On the other hand, the learned counsel appearing on

No.55694 of 2015 (2) dt.16-12-2015 behalf of the informant vehemently opposed the prayer and submitted that in fact, the informant party has received grievous injury on head and ear caused by hard and blunt substance. Admittedly, in this case, charge sheet has been submitted under Section 325 I.P.C. and according to the informant also, the informant has received grievous injuries. Considering the above facts and circumstances that there is land dispute between the parties and in relation to that, cases and counter cases and there was free fighting, I direct the petitioners named above to be released on bail on furnishing bail bond of Rs.5,000/-(Rupees five thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri-On-Sone, Rohtas in connection with Darihat P.S. Case No.50 of 2015.
