Although petitioner is named in the first information report but informant is not an eye-witness of the alleged occurrence and it appears that even in course of investigation not a single prosecution witness came forward to claim himself to be eye-witness of the alleged occurrence.

Dead body of the deceased was found in his house and name of the petitioner has been given in this case on account of previous enmity which is admitted in the first information report itself. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Mukesh Kumar Mishra, Judicial Magistrate, Ist Class, East, Muzaffarpur in Hathauri P.S. Case no. 50/2015.
