This application, for grant of anticipatory bail, arises out of Kalyanpur P.S. Case No. 72 of 2016 (G.R. No. 1474/2016), disclosing offences under Sections 341, 323, 379, 354, 427 and 504/34 of the Indian Penal Code.

Patna High Court Cr.Misc. No.43356 of 2016 (2) dt.26-10-2016 2/3 The petitioners are said to have entered into the house of the informant and attempted to outrage the modesty of her sister-in-law. They are said to have snatched valuables and cash.

It is submitted by learned counsel for the petitioners that petitioner Nos. 1 and 2 are full brothers and other petitioners are also closely related. It has further been submitted that the manner of occurrence as alleged in the First Information Report is highly improbable. It has been submitted that another F.I.R., bearing Kalyanpur P.S. Case No. 79 of 2016, has been registered in which the niece of petitioner No. 1 is the informant.

Considering the submission so advanced on behalf of the petitioners, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Kalyanpur P.S. Case No. 72 of 2016 (G.R. No. 1474/2016), subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the
