The petitioner seeks bail in a case registered under Section 412 of the Indian Penal Code and Sections 25(1b)a/26/35 of the Arms Act. Allegation is that one loaded country made pistol along with one live cartridge is recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.7.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. One loaded country made pistol along with one live cartridge is said to have been recovered. There is no compliance of Section 100 of Cr.P.C. On behalf of the State, it is submitted that the

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st, Saharsa in connection with S.Tr. No.85 of 2018 arising out of Sonbarsa Raj P.S. case No.91 of 2017.
