2. In this case, the petitioner is seeking regular bail in connection with Ara Nawada P.S. Case No. 453 of 2024, registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per allegation, on the basis of a secret information, the informant apprehended the petitioner with one Maruti Car bearing registration no. JH10A4165, and recovered 270 L of country made mahuwa liquor, which was to be delivered at Bind Toli.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated. Nothing

Patna High Court CR. MISC. No.59096 of 2024(2) dt.28-08-2024 2/2 has been recovered from the conscious possession of the petitioner. He is a person of clean antecedent and is under custody since 27.06.2024.

5. On the other hand, learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner, above-named, is directed to furnish bail bond after three months from today and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Bhojpur, Ara in connection with Ara Nawada P.S. Case No. 453 of 2024, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
