The petitioner is apprehending his arrest in a case registered under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

The prosecution case, in brief, is that informant's son proceeded to Salloon, but he did not reach the destination. After two days, the deadbody of son of the informant was found lying in Raja Ahar Bahiyar.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. The petitioner is not named in the FIR. His name has come in course

Patna High Court Cr.Misc. No.74081 of 2018(2) dt.20-12-2018 2/2 of investigation merely on the basis of suspicion. There is no eye witness to the alleged occurrence nor there is any substantive evidence to suggest the implication of the petitioner in the present case. The other co-accused namely Zaheer Ansari with similar allegation have been granted anticipatory bail by a coordinate bench of this court vide order dated 29-10-2018 passed in Cr. Misc. No. 55808 of 2018.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No. 29 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) A.K.V.//- U T
