The petitioner apprehends his arrest in Bariyarpur P.S. Case No. 119 of 2015 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that the petitioner and others came and abused her. When Ranjit, son of the informant, objected on such Rambriksh Mandal, the petitioner took Garasa from his wife and assaulted Ranjit on his head.
Learned counsel for the petitioner submits that the petitioner is elder brother of the husband of the informant. There is land dispute between the parties. The injury found on the head of Ranjit is opined to be simple in nature but, it appears that the petitioner had assaulted his own nephew with Garasa on his head
Patna High Court Cr.Misc. No.41410 of 2016 (2) dt.19-11-2016 2/2 and after X-ray the injury was found simple in nature. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, his prayer shall be considered on its own merit without being prejudiced by this order and taking into consideration that the injury found on the head is simple in nature and dispose of the bail petition preferably on the same day.
