JUSTICE BIRENDRA KUMAR ORAL ORDER 18-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 384/34 of the Indian Penal Code.

The petitioner has got no criminal antecedent and allegation is that when the police reached near the tempo stand on getting information that rupees thirty is being collected from each of the tempo driver, the petitioner was seen fleeing from the place of occurrence.

Considering the nature of material and the fact that the petitioner is in custody since 07.10.2017, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

Patna High Court Cr.Misc. No.58510 of 2017 (2) dt.18-12-2017 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Digha Police Station Case No. 346 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
