====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending her arrest in a case for the offence registered under Sections 304(B) and 201/34 of the IPC.

The prosecution story, in brief, is that the informant married his daughter Poonam Devi with one Rupesh Chaubey four years ago and at the time of Bidai, he gave cash Rs. 2,00,000/- and other things. Accused persons kept his daughter in their house with full owner and dignity for one year but after that they made demand of dowry and started torturing. He was informed by his daughter that her Sasural people were demanding Rs. 1,00,000/- and one Motorcycle and gave threatening to kill her. He went there and made request to the

Patna High Court Cr.Misc. No.73008 of 2018(2) dt.06-12-2018 2/3 period to illegal demand. He returned from there on 26.04.2018 and after that he was informed that his daughter has been killed by accused persons for dowry and kept the dead body in secretly.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is unmarried Nanad of the deceased. She is separate in mess and property from the husband of the deceased. The petitioner has got no concern with the alleged occurrence. The husbad of the deceased is in custody On behalf of the State, it is submitted that the petitioner is named in the F.I.R/ Complaint Case. Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned In-Charge Additional Chief Judicial Magistrate, Bagaha, West Champaran
