The petitioner is accused in connection with Daraunda P.S. Case No. 176/2014 registered under Section 147, 148, 149, 341, 323, 324, 307 & 504 of the Indian Penal Code. The accusation is that the petitioner gave spade blow at the head of the informant Champa Devi whereas other accused also assaulted her with lathi.
Learned counsel appearing on behalf of the petitioner submits that from the FIR it would appear that the occurrence took place due to logging of water in which the petitioner is said to have caused injury on the head of the informant. More so, there is no allegation of repeating the assault by this petitioner and the petitioner having no criminal antecedent is in custody since
Patna High Court Cr.Misc. No.57480 of 2015 (3) dt.16-02-2016 2/2 19.08.2015.
Having regard to the facts and circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Daraunda P.S. Case No. 176/2014. Out of two sureties, one surety must be the close relative of the petitioner.
