====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------ 18-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Kotwali P.S. Case No.145 of 2016 registered under Sections 304(B)/34 of the Indian Penal Code.

The accusation is of killing the deceased, the daughter of the informant, by her husband and in-laws for non fulfillment of the dowry demand of a motorcycle and cash Rs.2,00,000/-. Learned counsel appearing on behalf of the petitioner submits that the petitioner is the mother-in-law of the deceased and she used to reside separate in the same mohalla with the husband of the deceased but with an ulterior motive, the petitioner has falsely been implicated in this case. Further submission is that

No.43606 of 2016 (2) dt.18-10-2016 2/2 it would appear from the F.I.R. that no specific overt act of making demand of dowry and causing the death of the deceased for non-fulfillment of the same has been attributed to the petitioner. The husband of the deceased, namely, Uzwal Kumar, is already in custody since 28.03.2016.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No.145 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
