The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 354A, 427 and 504/34 of the Indian Penal Code. The prosecution case is that on 01.10.2018 at 6.00 A.M. when the informant being a teacher, was going to school, he was assaulted by the accused persons. It is alleged that the petitioner took out a purse from the wife of the informant containing mobile and seven thousand rupees.
It is submitted by learned counsel for the petitioner that the informant the cycle dashed a student by his car, whereupon on protest, the girl Madhu Kumri was assaulted and abused by the informant, which was condemned by the
Patna High Court Cr.Misc. No.73660 of 2018(2) dt.20-12-2018 2/2 petitioner and hence, the present case has been lodged. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that there is accusation of assault and snatching the jewellery and other articles. Considering the genesis of the occurrence coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 158 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
