The petitioner apprehend his arrest in connection with Complaint Case No.90(C) of 2013 registered for the offences punishable under sections 465, 467, 468, 471 and 420 of the Indian Penal Code.
The allegation against the petitioner is that he along with his brother has purchased the land which is jointly owned by the complainant along with his brother Shiv Narain Mehta. Learned counsel for the petitioner submits that the issue raised, is a civil dispute and that the brother of the complainant himself has sworn an affidavit that the transaction is valid.
Having heard learned counsel for the parties and
Patna High Court Cr.Misc. No.45882 of 2014 (2) dt.10-04-2015 taking note of the circumstances existing, let the petitioner, namely, Ram Prasad Mehta in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri T.A. Kumar, Judicial Magistrate, Birpur, District- Saharsa and/or the court concerned in connection with Complaint Case No.90(C) of 2013 subject to the conditions as laid down under section 438
(2) of the Code of Criminal Procedure.
