The petitioner seeks bail in connection with SC/ST Dehri P.S. Case No. 02 of 2015 registered under sections 341, 323, 504, 506, 376, 511, 447/34 of the Indian Penal Code and Section 3(i)(x)(xi) of the S.C./S.T. (Prevention of Atrocities) Act.
It is contended that there is no truth behind the allegations made in the first information report. It is further contended that a counter case has also been registered bearing Sasaram Mufassil P.S. Case No. 12 of 2015 by one Kesh Nath Singh under sections 341, 323, 504, 384/34 of the Indian Penal
Patna High Court Cr.Misc. No.57346 of 2015 (3) dt.05-02-2016 Code against Mahendra Paswan, Upendra Paswan, Ravi Paswan, Satendra Paswan, Shesh Nath Paswan, Mithilesh Paswan and Pradeep Paswan and the informant of the case is closely related to the accused persons of the aforesaid Sasaram Mufassil P.S. Case No. 12 of 2015. It has also been contended that the petitioner has got no criminal antecedent and he has been implicated in the case on account of village politics.
Learned counsel for the State has opposed the application for bail of the petitioner.
Be that as it may, regard being had to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 4th, Sasaram in connection with S.C./S.T. Dehri P.S. Case No. 02 of 2015.
