The petitioner apprehends his arrest in connection with Bithan P.S. Case no. 62 of 2016, registered under Section 7 of the E.C. Act.

Learned counsel for the petitioner submits that it would appear from the written report of Block Supply Officer, Bithan that in the light of D.R. No. 544/2016, dated 14.07.2016 of the Officer-InCharge, Bithan, he enquired to the beneficiaries connected with the PDS Shop of the petitioner, who disclosed about non-supplying of required grains to them. The driver of the tractor, from which 40 bags of rice were recovered, disclosed that he was carrying the same for selling the rice in black market and the said rice was loaded from the house of petitioner, who is a PDS dealer. The name of the petitioner has been implicated in this case only on the basis that the driver of the

Patna High Court Cr.Misc. No.43555 of 2016 (2) dt.05-10-2016 2/2 tractor disclosed that the said rice bags were loaded from the house of petitioner to sell in the black market, but his statement has not been detailed, while the statements of beneficiaries is attached with the written report by the informant.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Rosera, Samastipur in connection with Bithan P.S. Case No. 62 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
