Learned counsel for the petitioners submits that above named petitioner no. 1 has already been died, therefore the application on behalf of above named petitioner no.1, stands withdrawn and the application is now restricted on behalf of above named petitioner no. 2 only.

Patna High Court CR. MISC. No.66876 of 2021(2) dt.17-05-2022 2/3 The petitioner no. 2 apprehend his arrest in connection with Magadh University P.S. Case No. 73 of 2019 registered for the offences punishable under Sections 406,409,420,467,468,471,120B of the Indian Penal Code. Submission is that allegation against the petitioner no. 2 and others is that they were members of the Inspection Team and they submitted a favourable report in favour of the College though the college was not fulfilling criteria. Other co-accused have already been allowed anticipatory bail.

Considering the facts and circumstances, the present anticipatory bail application is allowed.

Accordingly, let the petitioner no. 2 above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Gaya in connection with Magadh University P.S. Case No. 73 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. as well as condition that the petitioner no. 2 shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner no. 2.
