The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 354, 376, 504, 506/34 of the Indian Penal Code.

As per prosecution story, on the pretext of marriage, petitioner had established physical relationship with the victim/informant to which later on, he denied. Accordingly, the FIR has been lodged.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in the present case due to dirty village politics. The statement of victim recorded under section 164 of

Patna High Court CR. MISC. No.55560 of 2022(2) dt.16-02-2023 2/2 Cr.P.C. from which it appears that informant is a consenting party and she has not made allegation against the petitioner for any wrongful act forcefully. It is further submitted that the informant is already a married and matured mind woman. Moreover, the petitioner is languishing in judicial custody since 1.8.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sadar P.S. Case No. 303 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga.
