JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against petitioner is that he took loan of Rs.80,000,00/- (eighty lacs only) from the informant-bank and mortgaged the stock and other articles to secure the aforesaid loan amount but allegedly, he dishonestly, sold his stock before making payment of loan amount.

Contention on behalf of the petitioner is that the land and other things of the petitioner have been mortgaged with the bank and as a matter of fact, before institution of the present case, no notice, regarding realization of loan amount, was given to the petitioner by the concerned bank.
