This application for anticipatory bail arises out of Harsidhi P.S. Case No. 217 of 2018, disclosing offences under Sections 341, 323, 308, 504 and 34 of the Indian Penal Code. On perusal of the first information report, I find that the occurrence alleged is the result of some dispute in the village among various persons.

Learned counsel for the petitioner contends that all offences are bailable, except the offence under Section 308, which is not made out against the petitioner. Considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the Court below,

Patna High Court Cr.Misc. No.73202 of 2018(2) dt.19-12-2018 2/2 be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of learned C.J.M. Motihari, East Champaran, in Harsidhi P.S. Case No. 217 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
