This application for anticipatory bail arises out of Parasbigha P.S. Case No. 135 of 2018, disclosing offences under Sections 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.
From the first information report, it is evident that the informant and the accused persons are agnates and there is a dispute arising out of partition in the family. It is alleged that in respect of the dispute, the complainant had gone to the Police Station when the accused persons including the petitioner entered into the complainant's house, assaulted his daughter-inlaw and snatched her jewelries. It is also alleged that one coaccused and the present petitioner had tried to obtain K.C.C.
Patna High Court Cr.Misc. No.73193 of 2018(2) dt.19-12-2018 2/2 loan against his land by making forged signature. Considering the nature of dispute, which is the background of registration of the first information report, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st in Parasbigha P.S. Case No. 135 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
