ANJANA MISHRA ORAL ORDER 15-11-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 03.12.2016 in connection with S.Tr. No.79 of 2017 arising out of Sikandra P.S. Case No.145 of 2016 registered for the offence under Sections 395 and 397 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., but his name has surfaced on the basis of the confessional statement made before the police by one Kundan Kumar Yadav, who has since been released on bail in Cr.Misc. No.24042 of 2017, vide order dated 22.06.2017. It is further submitted that till date, the petitioner has not been placed on T.I. Parade and

Patna High Court Cr.Misc. No.52106 of 2017(2) dt.15-11-2017 2/2 is languishing in jail.

In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II, Jamui, in connection with S.Tr. No.79 of 2017 arising out of Sikandra P.S. Case No.145 of 2016.
