JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One TVS Star City motorcycle bearing Registration No. BR-30A-2338 is said to have been recovered from the cow shed of the petitioner but submission on behalf of the petitioner is that the aforesaid motorcycle had been recovered from the field of one Atma Paswan, much earlier to institution of the present case, for which, Sadar (Mahhi) P.S. Case No. 427 of 2015 was registered on 23-08-2015 against the aforesaid Atma Paswan and others.

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that petitioner does not have any criminal antecedent,

Patna High Court Cr.Misc. No.249 of 2016 (2) dt.06-01-2016 2/2 let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sadar (Bhalpatti O.P.) P.S. Case No. 470 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Darbhanga.
